MP Landscape & Garden Design – Terms & Conditions

1. Introduction
These Terms & Conditions set out the basis on which I provide professional garden and landscape design services. By commissioning any design work, the client agrees to these terms. I offer a design‑only service. I do not carry out construction, landscaping, planting, or any physical works. All construction and installation must be undertaken by independent contractors appointed directly by the client.

2. Scope of Services
My services may include:
• Site visits and consultations
• Concept design and layout planning
• Masterplans, visuals, and presentation drawings
• Technical guidance relating to design intent
• Material suggestions and outdoor living solutions
• Outdoor kitchen design through Food & Fire Outdoor Living
​
• Project monitoring to ensure the design intent is followed
My services do not include:
• Construction, installation, or physical works
• Structural, drainage, electrical, plumbing, or engineering design
• Planting plans or horticultural services
• Contract administration or project management
• Health and safety supervision or site management

• Warranty, guarantee, or certification of any contractor’s work
​
3. Contractors and Third‑Party Services
​
Any contractors suggested during the design process are independent third parties. Recommendations are provided purely as options for the client’s consideration. Clients must carry out their own due diligence before appointing a contractor, including checking references, insurance, qualifications, and suitability for the project.
I accept no responsibility or liability for:
• Contractor performance or conduct
• Workmanship, pricing, or timescales
• Guarantees, warranties, or defects
• Construction methods or technical compliance

• Specialist works such as drainage, electrics, plumbing, groundworks, or structural elements
​
All responsibility for construction and installation lies solely with the appointed contractor.
​
4. Project Monitoring
Where project monitoring is requested, my role is limited to ensuring the design intent is followed. This does not include:
• Supervising construction methods
• Approving technical decisions
• Managing contractors
• Ensuring compliance with building regulations or safety standards

• Signing off works or certifying completion
​
Project monitoring does not transfer any responsibility for the contractor’s work to me.
​
5. Client Responsibilities
The client is responsible for:
• Providing accurate site information and access
• Ensuring all legal permissions, planning approvals, and utilities checks are completed
• Appointing competent contractors
• Ensuring the site is safe and compliant with regulations
• Paying contractors directly

• Reviewing and approving designs before construction begins
​
The client must notify me of any changes to site conditions, boundaries, or requirements.
​
6. Fees and Payment
Fees and Payment (Updated)
Design fees will be confirmed in writing before work begins.
​
• Consultation fees are payable on the day of the visit.
​
• Once the client agrees to the proposed costs, a formal quote is issued for acceptance. When the client accepts the design service, an invoice is generated and must be paid in full before any design work starts.
​
• No design work will commence until payment has been received.
• Late payments may delay progress.
​
All fees relate to design services only and do not include contractor costs.
​
7. Intellectual Property
​
All drawings, plans, visuals, and written materials remain the intellectual property of MP Landscape & Garden Design. They may not be reproduced, shared, or used for construction without full payment. I retain the right to photograph completed projects and use images for portfolio, website, and marketing purposes.

8. Changes and Revisions
​
Minor adjustments may be included within the agreed fee. Significant changes, redesigns, or additional drawings requested after approval of a design stage may incur additional charges.

9. Site Conditions and Accuracy
Designs are based on the information provided at the time of the survey. I am not responsible for:
• Hidden or unknown site conditions
• Inaccurate measurements provided by the client or contractor
• Changes made on site without my knowledge
​
• Issues arising from drainage, soil conditions, utilities, or structural elements
​
Contractors must verify all dimensions and levels before construction.
​
10. Liability
I hold professional indemnity insurance appropriate for design‑only services. I am not liable for:
• Contractor workmanship or performance
• Delays, defects, or financial loss caused by third parties
• Structural, drainage, electrical, plumbing, or engineering issues
• Accidents, damage, or safety incidents on site

• Decisions made by the client or contractor without my written approval
Nothing in these terms limits liability where it cannot be excluded by law.

11. Cancellation
Either party may cancel the agreement in writing. Fees for work completed up to the cancellation date remain payable.

12. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
​
13. Acceptance
By commissioning MP Landscape & Garden Design, the client confirms acceptance of these Terms & Conditions.
